Agreement to Terms

Welcome to Skin Genie ("App," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of the Skin Genie mobile application operated by Kishan Patel.

By accessing or using Skin Genie, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our App.

Eligibility

You must be at least 13 years old to use Skin Genie. By using the App, you represent and warrant that you meet this age requirement.

If you are between 13 and 18 years old, you must have permission from a parent or legal guardian to use the App.

Account Registration

Creating an Account

To use Skin Genie, you must create an account by providing:

• Your name
• Email address
• Age range
• Ethnicity
• Gender
• Skincare concerns

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

Account Sharing

Account sharing is strictly prohibited. Each account is for individual use only. You may not:

• Share your login credentials with others
• Allow others to access your account
• Use another person's account

While you may create multiple accounts, each account must have unique credentials and be used by you individually.

NOT Medical Advice

The App's analysis and recommendations:

• Are for informational and educational purposes only
• Should not be used to diagnose, treat, or prevent any skin condition or disease
• Do not replace consultation with a qualified dermatologist or healthcare professional

If you have any medical concerns about your skin, including but not limited to acne, rashes, unusual marks, or other skin conditions, you should consult a licensed healthcare provider or dermatologist.

By using Skin Genie, you acknowledge that you understand this disclaimer and will not rely on the App for medical advice or treatment.

Services Provided

AI Skin Analysis

Skin Genie uses artificial intelligence (Claude by Anthropic) to:

• Analyze photos of your face
• Grade your skin across multiple categories
• Provide personalized skincare recommendations
• Suggest a skincare regimen based on your specific concerns

Photo Requirements

When uploading photos:

• Photos must be of your own face
• Photos should be clear and well-lit for accurate analysis
• You must have the right to upload and use the photos
• Photos will be used solely for your personal AI analysis

Subscription and Payment Terms

Subscription Plans

Skin Genie offers the following subscription options:

• Weekly Subscription: Billed weekly
• Yearly Subscription: Billed annually

Free Trial

We may offer a free trial period (currently 3 days, subject to change). During the trial:

• You have full access to premium features
• You will not be charged during the trial period
• You can cancel anytime before the trial ends to avoid charges
• If you do not cancel, your subscription will automatically begin, and you will be charged

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method for each renewal period.

Payment

Payment is processed through your device's app store (Apple App Store or Google Play Store). All payments are handled by Superwall and subject to the app store's payment terms.

Cancellation

You may cancel your subscription at any time through your device's subscription settings. Cancellation will take effect at the end of your current billing period. You will retain access to premium features until that date.

Refunds

All payments are non-refundable except as required by law or as determined by the app store's refund policy. We do not provide refunds for:

• Partial subscription periods
• Unused portions of your subscription
• Dissatisfaction with results or recommendations

Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply upon renewal. We will notify you of any price changes before they take effect.

User Content and Intellectual Property

Your Photos

When you upload photos to Skin Genie:

• You retain all ownership rights to your photos
• You grant us a limited license to use your photos solely for providing AI analysis to you
• Your photos will not be shared with third parties (except Claude AI for analysis purposes)
• Your photos will not be used for marketing, training, or any purpose other than your personal skincare analysis
• You can delete your photos at any time by deleting your account

Our Intellectual Property

All content, features, and functionality of Skin Genie, including but not limited to text, graphics, logos, images, software, code, AI analysis algorithms and methods, and design and user interface, are owned by Kishan Patel and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute any part of the App
• Reverse engineer or attempt to extract source code
• Create derivative works based on the App
• Use the App's content for commercial purposes

Prohibited Uses

You agree NOT to:

• Use the App for any illegal purpose or in violation of these Terms
• Upload photos of anyone other than yourself
• Upload inappropriate, offensive, or explicit content
• Attempt to hack, disrupt, or damage the App
• Use automated tools or bots to access the App
• Impersonate another person or misrepresent your identity
• Share or distribute results or recommendations as professional medical advice
• Reverse engineer or copy any aspect of our AI analysis methods
• Resell or commercially exploit any part of the service

Violation of these prohibited uses may result in immediate termination of your account.

Disclaimers and Limitations of Liability

No Guarantees

SKIN GENIE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not guarantee:

• The accuracy of AI analysis or recommendations
• Specific results from using our recommended skincare regimens
• That the App will be error-free or uninterrupted
• That defects will be corrected
• That the App is free from viruses or harmful components

Results May Vary

Skincare results vary significantly from person to person based on numerous factors including genetics, lifestyle, diet, climate, and consistency of product use. We make no guarantees or warranties about the effectiveness of recommended products or routines, improvement in your skin condition, timeframes for seeing results, or prevention of skin issues.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KISHAN PATEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA, USE, OR GOODWILL, SERVICE INTERRUPTION OR DATA LOSS, OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP OR RESULTING FROM FOLLOWING OUR RECOMMENDATIONS.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF SKIN GENIE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS LESS.

Assumption of Risk

You acknowledge and agree that:

• You use Skin Genie at your own risk
• You are solely responsible for any decisions you make based on the App's recommendations
• You should consult with a dermatologist before starting any new skincare routine
• We are not responsible for allergic reactions, skin irritation, or adverse effects from products you choose to use

Indemnification

You agree to indemnify, defend, and hold harmless Kishan Patel and Skin Genie from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, your violation of any rights of another party, or content you upload to the App.

Termination

By You

You may terminate your account at any time by deleting your account through the App settings. Upon deletion:

• All your personal data and photos will be permanently deleted
• Your subscription will be canceled (effective at the end of the current billing period)
• You will lose access to all premium features

By Us

We reserve the right to suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You engage in prohibited uses
• We suspect fraudulent or illegal activity
• We discontinue the App

Termination does not entitle you to a refund for any unused portion of your subscription.

Dispute Resolution and Governing Law

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Mandatory Arbitration

You and Kishan Patel agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Skin Genie (collectively, "Disputes") will be settled by binding arbitration, except that:

• You may assert claims in small claims court if your claims qualify
• Either party may seek injunctive or equitable relief in court for disputes related to intellectual property rights or unauthorized use of the App

BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO HAVE DISPUTES HEARD BY A JUDGE OR JURY.

Arbitration Process

• Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
• The arbitration will be held in New York County, New York, or at another mutually agreed location
• Each party will bear their own costs and fees unless the arbitrator determines otherwise
• The arbitrator's decision will be final and binding
• Judgment on the award may be entered in any court having jurisdiction

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the Dispute between you and Kishan Patel individually. To the full extent permitted by law:

• NO CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS ARE PERMITTED
• You may not bring a claim as a plaintiff or class member in any class, consolidated, or representative action
• The arbitrator may not consolidate more than one person's claims

Opt-Out

You have the right to opt out of this arbitration agreement. To opt out, you must notify us in writing within 30 days of first accepting these Terms. Your opt-out notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration agreement. Send your opt-out notice to skingenieapp@gmail.com.

If you opt out, you and Kishan Patel agree to resolve Disputes in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top
• We will notify you through the App or via email
• Your continued use of the App after changes take effect constitutes acceptance of the new Terms

If you do not agree to the modified Terms, you must stop using the App and delete your account.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Kishan Patel regarding Skin Genie and supersede any prior agreements.
